Scope
With this clause issued in accordance with the General Terms and Conditions of Professional Liability Insurance published in the Official Gazette dated 16 March 2006 and numbered 26110, the insurer, subject to the conditions in the contract, covers the compensation amounts that the insured is obliged to pay or will be obliged to pay due to damages arising from the insured's failure to perform his duty duly, failure to fulfil his duty of care to his client or other defective behaviours while performing the professional activity specified in the policy, as well as the judicial expenses and attorney's fees, if agreed, within the limits written in the policy.
Conditions Excluded from Coverage
Without prejudice to the provisions of article "A.3. Conditions Excluded from Coverage" of the General Terms and Conditions of Professional Liability Insurance, damages that may arise as a result of not preserving or misusing client-related secrets are excluded from coverage.
Indemnity Claims that can be Covered by an Additional Contract
Without prejudice to the provisions of the article "A.4 Conditions Excluded from Coverage, Claims for Compensation and Payments Unless Agreed Otherwise" of the General Terms and Conditions of Professional Liability Insurance;
Compensation claims that may be made under laws other than the legislation of the Republic of Turkey,
Compensation claims that may arise from the wilful acts of persons for whose acts the insured is responsible,
Claims for damages arising from the misinterpretation or application of foreign legislation or failure to comply with them are excluded from the coverage, unless there is a contract to the contrary.
