CLINICAL RESEARCH LIABILITY INSURANCE
Clinical research is carried out in cases such as finding a cure for a certain disease, improving known treatment methods, developing new diagnostic methods. Risks may arise for employees during all these researches. In order to protect these risks, "Clinical Research Liability Insurance" is provided.
Clinical Research Liability Insurance is related to the payment of insurance indemnity against the consequences of "Bodily Damage" claims to be brought by the volunteer due to the death, injury or impairment of the health of the volunteer participating in a clinical research conducted within the geographical borders after the policy inception date by the sponsor(s) of the researches of the insured in accordance with the provisions of the regulation and other relevant legislation within the framework of the limits, exceptions, terms and conditions included in the insurance contract for the liability arising in accordance with the legislation of the Republic of Turkey on legal liability and in particular up to the limit of liability specified in the policy.
Clinical Research Liability Insurance is related to the payment of insurance compensation for the liability arising in accordance with the legislation of the Republic of Turkey regarding legal liability, within the framework of the limits, exceptions, terms and conditions included in the insurance contract and in particular up to the limit of liability specified in the policy provided that these claims have been addressed to the insured in writing within the insurance period and the insured has notified the insurer of these claims within the insurance period or within 30 days from the policy expiry date. This insurance, which is made in order to secure the damages and possible risks that may occur to volunteers / patients participating in laboratory studies, is the supporter of the research.
Conditions that may be subject to damage:
Death of the volunteer participating in the clinical research
Injury to the volunteer participating in the clinical research
Deterioration of the health of the volunteer participating in the clinical research
Conditions Excluded from Coverage:
Bodily harm suffered by an employee
Prevention of pregnancy/gestation resulting from any kind of clinical research
Claims and actions in respect of any damage caused by or in connection with Asbestos (Amiant) or substances containing Asbestos (Amiant)
Any health problem or syndrome related to IDS or variations or derivatives or strains of viruses, however expressed, that are linked to something similar, or due to hepatitis caused directly/indirectly by human T-cell lymphotropic virus (HTL virus)
Judicial or administrative penalties, contractual penalties, fines, punitive damages
Clinical research on genetic engineering, other than clinical trials for the diagnosis, treatment or prevention of a disease
Radioactive contamination caused directly or indirectly
An event known to the insured at the commencement date
Injuries foreseen by the insured or any other party to give rise to claims under the insurance contract
Damages, losses, claims for damages, other claims or actions arising out of or in any way related to asbestos or asbestos-containing materials
Liability arising directly or indirectly from war, all kinds of war events, invasion, foreign enemy movements (whether war has been declared or not), civil war, revolution, rebellion, insurrection, and the security and military actions required by them
